A trial will be held for two correctional officers in connection with the 2013 death of Adam Kargus at the Elgin-Middlesex Detention Centre.
Charges against a third guard were dropped at a preliminary hearing in Jan. 2015.
Kargus, 29, of Sarnia, had been beaten to death. His body was found the next morning in the shower area of the detention centre.
Operational manager Stephen Jurkus and corrections officer Leslie Lonsbary are both charged with failing to provide the necessaries of life in his death.
Kargus' cellmate, Anthony George, has been charged with second-degree murder in the case. Another inmate, David Cake, has already pleaded guilty to obstruction of justice.
A number of staff at EMDC were also terminated following the death.
The decision to move ahead with a trial comes just after the Kargus family reached an out-of-court settlement in a $4.2 million lawsuit against the province.
A ban was placed on evidence heard at the preliminary hearing, so it won't be made public until it is presented at trial.
A date for the trial is expected to be set in February.
