A class action lawsuit against the province on behalf of former Elgin-Middlesex Dentention Centre inmates is going ahead.
“We are very pleased that individuals who were exposed to the conditions at EMDC will be allowed to go forward with their claims on a class basis. We look forward to the next steps in this litigation,” said Kevin Egan in a release. He's a lawyer at McKenzie Lake Lawyers who spearheaded the action.
The suit relates to conditions at the detention centre.
The Ontario Superior Court of Justice ruled Tuesday the class action suit be certified.
The suit was filed in December 2013 alleging the conditions at EMDC are overcrowded, fraught with violence, and violate sections of the Canadian Charter of Rights and Freedoms.
The class action includes inmates incarcerated at the EMDC between January 1, 2010 and August 25, 2013, including those held at the facililty pending trial or other court appearances.
