Police lay charges in fatal Costco collision
London police have laid three charges against a 65-year-old old woman in connection with the fatal crash at a south London Costco.
Speaking at a press conference on Friday, London police Sgt. Amanda Pfeffer said 65-year-old Ruth Burger of London is facing charges of criminal negligence causing death and two counts of criminal negligence causing bodily harm.
"Criminal negligence doesn't necessarily have to indicate intent, as for the specifics in relation to the evidence that we have to make out that offence, again that is what would be before the courts at this time. "
The first count relates to the death of six-year-old Addison Hall, while the latter two relate to the injuries sustained by 26-year-old Danah McKinnon-Bozek and three-year-old Miah Bozek.
As for why no charges were laid in connection with the death of the newborn, who was delivered by C-section after the crash, Pfeffer says "The definition of the criminal code has some stipulations that require that a person becomes a person essentially when it is born from its mother in a living state."
Pfeffer added that several mechanical investigations have been conducted on the vehicle involved, but that information - along with the driver's medical state - are now part of a court case and no further information can be released.
Although charges have been laid, police say the investigation continues. While they have surveillance video, police continue to ask anyone who may have witnessed the collision and has not already spoken to police to contact them.
Around noon on July 25, a vehicle reversed into the entrance of the Costco on Wellington Road, injuring six people. An adult male and female were treated for minor injuries and released from hospital that day.
Addison died in hospital that night, and her newborn baby sister Rhiannon Bozek also died in hospital on Aug. 1st.
Their sister Miah was admitted in critical condition and remains in hospital in good condition while their mother, who was also critical at the time, has been released from hospital.
Burger has been released from custody and is scheduled to appear in court again on Sept. 16.
