A mistrial has been declared in the Ryker Daponte-Michaud death case.

One of the accused, Amanda Dumont was in court Monday but is incredibly ill with appendicitis.

The judge said that since Dumont was prescribed narcotics, she cannot fully participate in her trial -- which is her right.

The judge also noted that since it's Christmas and one of the juror's has a trip booked and one lawyer has a trial in the new year, a mistrial had to be declared.

Jurors have been offered psychological counselling.

Dumont, 30, and her partner Scott Bakker, 27, were charged with criminal negligence causing death and failing to provide the necessaries of life after baby Ryker was burned by a cup of hot instant coffee in Strathroy in May of 2014.

The case returns Tuesday to Assignment Court to possibly set a new trial date.
