An 88-year-old London man has been found guilty of assaulting police.

Serge Zubko was levied the verdict Tuesday afternoon in a London court. Zubko says police left him with cuts and bruises after officers responded to his Highbury Avenue home in July of 2013.

Officers were called by a concerned citizen to check on the welfare of an elderly woman, who claimed she was attacked by a stranger in her home. It was later learned that this woman was Zubko's 89-year-old wife, who suffers from dementia and is now living in a nursing home.

While testifying Zubko said, “We had arguments, but I never hurt my wife. Never, never."

The Crown maintains that when police showed up, Zubko, who was watching TV inside his home, was the aggressor and he received the cuts when he fell after he was handcuffed.

During closing arguments, Crown Attorney Tim Zuber said, "It’s an unfortunate situation...it could have been handled differently if he had co-operated with police."

Justice Jonathon George found that police acted appropriately. After the guilty verdict, Zubko was given an absolute discharge because of his age and circumstances around the incedent.

Zubko says he is relieved with the absolute discharge, which means he will not have a criminal record.
