Charges have been laid against a 47-year-old driver following a crash in August that left a passenger dead.

Timothy Summers of Oneida Nation of the Thames First Nation has been charged with impaired driving, impaired driving causing bodily harm and impaired driving causing death.

Oneida Nation of the Thames First Nation Police, Middlesex County OPP and Chippewas of the Thames First Nation Police were called to Fairgrounds Road south of Oneida Road around 3:30 a.m. on Aug. 31 for collision.

Police say an SUV carrying three men was travelling on Fairgrounds Road when left the roadway and rolled over.

One passenger suffered non-life-threatening injuries and was treated in hospital while a second passenger, 59-year-old Carl Doxtator of Oneida Nation of the Thames First Nation was declared dead at the scene.

Summers suffered non-life threatening-injuries and was treated in hospital.

He has been released from custody and is scheduled to appear in a London courtroom Oct. 9.
