On the same day police warned motorists they’d be enforcing the Move Over law, an Elgin OPP officer had a close call on the shoulder of Highway 401.

It was noon on Wednesday when the officer was stopped on the shoulder of an eastbound lane, just past Furnival Road to assist with a flat tire.

The officer had his emergency lights activated to indicate to traffic to slow down and move over.  The officer also set up flares along the white fog line.

Police say a tractor trailer hauling garbage failed to move over and at the last moment made a sudden steering correction. This caused all the flares to be knocked over. No contact was made with the police cruiser or the other vehicle.

A 32-year-old Stoney Creek man is charged with careless driving and failing to move into another lane for an emergency vehicle or tow truck.

The Move Over law carries a fine of between $400 to $2,000 and three demerit points.

Since 1989, five OPP officers have died when they or their roadside vehicles were struck by approaching vehicles.
